Mahendra Patel was arrested for allegedly attempting to kidnap a toddler at an Acworth, Georgia, Walmart
ACWORTH, Ga. — Mahendra Patel, the 56-year-old Kennesaw resident who was arrested last month on charges of kidnapping a toddler from a Walmart in Acworth, has been released from jail after a bond hearing was conducted on May 6. Patel’s release follows increasing controversy surrounding surveillance video that his attorney claims refutes the original charges.
The event happened on March 18 at the Walmart located at 3105 Cobb Parkway. The police reports say Patel approached a mother, Caroline Miller, and asked where Tylenol was located before purportedly trying to grab her 2-year-old son from her arms. Miller was able to hug her child away, and Patel allegedly left the scene. He was arrested three days later and charged with felony kidnapping, simple assault, and simple battery.
Patel’s lawyer, Ashleigh Merchant, has since then released footage from the store’s surveillance, contending that the tape indicates Patel merely was attempting to keep the child from falling from the mother’s motorized shopping cart, instead of attempting a kidnapping.
During the video, Patel is viewed engaging with Miller and then directing her to some Tylenol he discovered, to which she gives a thumbs-up sign. Merchant argues that this exchange is a case of misunderstanding, not a criminal act.
